These Terms of Use (“Terms”) govern your access to and use of the SmileX Design mobile application (“the App”, “we”, “us”).
By accessing the App, creating an account, or subscribing, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the App.
1. Acceptance of Terms
By using SmileX Design, you confirm that:
- You have read and understood these Terms
- You agree to comply with them
- You are legally capable of entering into this agreement
2. Intended Use
SmileX Design is intended exclusively for professional use by dental specialists and technicians.
The App is a digital smile design and visual planning tool.
The App may include two-dimensional image processing, facial landmark detection, face contour analysis, face shape analysis, facial proportion measurements, and smile design suggestions to support visual aesthetic planning.
Face shape analysis and tooth shape suggestions are provided for visual, aesthetic, and communication purposes only.
The App does not provide medical diagnosis, clinical advice, treatment recommendations, clinical decision support, biometric identification, or identity verification.
Face shape classifications, facial measurements, smile design suggestions, and tooth shape directions may vary depending on image quality, facial angle, lighting, calibration, manual point adjustment, and other factors.
All clinical decisions, treatment planning, professional judgment, patient consent, and compliance with local medical regulations remain the sole responsibility of the user.
3. User Account
You must create an account to access the App.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities conducted under your account.
You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Payments
4.1 Subscription Model
The App is available through paid subscriptions monthly or yearly.
A 7-day free trial may be offered to new users.
Subscription features are available only while the subscription is active.
4.2 In-App Purchases
Payments are processed exclusively via:
- Apple In-App Purchase
- Google Play Billing
Pricing, currency, and availability may vary by region or platform.
We do not store or process payment card details.
4.3 Auto-Renewal, Trial, and Cancellation
Subscriptions may renew automatically unless canceled at least 24 hours before the end of the current billing period, in accordance with the app store’s policies.
If a free trial is offered, it may automatically convert into a paid subscription unless canceled before the trial period ends.
Users can manage or cancel subscriptions at any time through their Apple App Store or Google Play account settings.
Refund requests are handled exclusively by Apple or Google in accordance with their respective refund policies.
4.4 Subscription Restrictions
- Each subscription is valid for one user only
- A maximum of two devices may be associated with one account
- Simultaneous use on two devices is not permitted
Access from a third device requires contacting customer support and may require account verification.
Attempts to bypass subscription, licensing, or device restrictions may result in suspension or termination in accordance with these Terms and applicable app store policies.
5. Subscription Expiry or Cancellation
If a subscription expires or is canceled:
- New cases cannot be created
- Existing cases cannot be edited
- PDF reports cannot be generated or exported
Previously stored local data remains on the user’s device unless deleted by the user.
6. User Content and Patient Data
Users are solely responsible for all data entered into or processed within the App, including patient information, images, notes, facial landmarks, face contour points, facial measurements, face shape analysis results, smile design results, and PDF reports.
All patient data is stored locally on the user’s device only.
Users must obtain all legally required patient consents before entering, capturing, or processing any patient data, including patient images and any face shape or facial landmark analysis performed within the App.
Users are solely responsible for ensuring that their use of patient data complies with applicable privacy, data protection, medical record, biometric data, and professional healthcare laws.
7. Device Permissions
Certain features of the App require granting access to device functions, including:
- Camera: To capture images within the App
- Photos / Gallery: To select existing images from the device
- Storage / Files: To save or export images, results, and PDF reports
Images selected or captured through these permissions may be processed locally to detect facial landmarks, analyze face shape, and support smile design workflows.
Granting these permissions is required for core App functionality and is performed only with user consent.
8. Data Export and Sharing
The App allows users to export or share images and PDF reports.
Once data is shared outside the App, it is no longer under the control of SmileX Design.
Users are solely responsible for any third-party recipients and subsequent handling of shared data.
9. Account and Data Deletion
Deleting an account does not automatically cancel any active subscription. Users must manage or cancel subscriptions through their Apple App Store or Google Play account.
Users may delete their account directly from within the App or request deletion through customer support or the account deletion page made available for the App.
Deleting the account from within the App will permanently remove all locally stored data on the device, including patient data, images, facial landmarks, face shape analysis results, facial measurements, design records, and saved files.
This action is irreversible, and we are not responsible for recovering any deleted data.
Account deletion requests will be processed within a reasonable timeframe after verification.
10. Prohibited Use
Users must not:
- Use the App for unlawful purposes
- Share login credentials with others
- Reverse engineer, decompile, or tamper with the App
- Circumvent subscription, licensing, or device limitations
- Use the App for misleading, fraudulent, or non-professional medical purposes
- Use the App in violation of applicable data protection or privacy laws
- Use the App or its face analysis features for identity recognition, biometric identification, user verification, or surveillance purposes
11. Intellectual Property
All intellectual property rights, including software, designs, algorithms, and content, belong to SmileX Design.
Users are granted a limited, non-exclusive, non-transferable, and revocable license to use the App in accordance with these Terms.
Unauthorized copying, modification, distribution, or resale is prohibited.
12. Availability and Modifications
We reserve the right to modify, update, suspend, or discontinue the App or any part of its functionality at any time.
Continuous, uninterrupted, or error-free availability is not guaranteed.
13. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind.
We do not warrant:
- The accuracy of design outputs
- The accuracy of face shape analysis, facial measurements, or facial landmark detection
- The suitability of results for any specific clinical outcome
- The suitability of tooth shape suggestions for any specific patient or treatment plan
- The achievement of particular medical or aesthetic results
Face shape analysis, tooth shape suggestions, smile simulations, measurements, and reports are visual planning references only.
Use of the App is at the user’s own risk.
14. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for clinical decisions or treatment outcomes
- We are not responsible for any reliance on face shape analysis, tooth shape suggestions, facial measurements, or visual smile simulations as clinical instructions
- We are not responsible for data loss caused by device failure, operating system issues, or user actions
15. Termination
We may suspend or terminate access to the App, as reasonably necessary, for violations of these Terms, misuse, or attempts to bypass technical or subscription safeguards.
16. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where the App is operated, unless local law provides otherwise.
17. Changes to These Terms
These Terms may be updated periodically.
Changes take effect upon posting with an updated “Last Updated” date.
